IRS determination is the IRS's decision — not ours. We prepare accurate, complete applications. IRS timelines average 3–6 months for 1023-EZ and 6–12+ months for full 1023. We do not guarantee approval.

Common questions

Can I upgrade packages later?

Yes. You may upgrade from Starter to Standard or Complete within 60 days of purchase by paying only the price difference. Documents already delivered roll forward — we don't restart from scratch. Contact us to initiate an upgrade after your initial delivery.

What if my state has unusual requirements?

We prepare documents for all 50 states. Some states — particularly California, New York, Massachusetts, and Pennsylvania — have additional formation requirements, additional board governance rules, or more complex charitable solicitation registration processes. We flag these during intake. If your state situation is highly complex, we may recommend an attorney supplement our documents before filing.

Do I need a lawyer?

BOOJEE handles document preparation the same way LegalZoom or Incfile does — many organizations form successfully without an attorney. However, if your situation involves complex governance structures, international activities, prior legal issues, conversion from a for-profit entity, or significant existing assets, an attorney review is strongly advised. We are not a law firm and do not provide legal advice. We will flag attorney-referral situations during intake.

Is my 501(c)(3) status automatic after filing?

No. State incorporation and IRS tax exemption are two completely separate steps — and the IRS decision is the IRS's alone. After we deliver your documents, you file with the state (which makes you a legal corporation) and then file the IRS application (which is what establishes tax-exempt status). You must receive the IRS determination letter before donations are legally tax-deductible. BOOJEE does not guarantee IRS approval.

What is the difference between Form 1023 and Form 1023-EZ?

Form 1023-EZ is a streamlined, shorter application available to organizations projecting under $50,000 in gross receipts per year and under $250,000 in total assets — and meeting certain other criteria. Most new nonprofits qualify. We assess eligibility during intake. If your organization doesn't qualify for 1023-EZ, we prepare the full Form 1023 narrative at no upcharge — both are included in Standard and Complete.

How long does IRS review take after I file?

IRS processing times are set by the IRS and outside our control. As of mid-2026, Form 1023-EZ is typically averaging 3–6 months; the full Form 1023 averages 6–12+ months. Some cases move faster, some slower. We recommend filing promptly and planning your fundraising timeline accordingly — you can often begin operations as a corporation before the determination letter arrives, though tax-deductible donations must wait for determination.

What government fees will I pay separately?

State incorporation fee: typically $25–$150 depending on your state. IRS Form 1023-EZ: $275. IRS Form 1023 (full): $600. EIN from the IRS: free. State charitable solicitation registration (if required in your operating state): varies from $0 to $200+ depending on state. None of these are included in BOOJEE's service fee — you pay them directly to the agencies when you file.
